The following Terms and Conditions govern your use of the online booking system and the services provided by all tutors and associate tutors of HKSpanishtutoring. By using the online booking system and engaging in lessons delivered by any of our tutors, you agree to be bound by these Terms. It is essential that you read and understand these Terms before using the online booking system and/or other communication channels to book language lessons with any of our tutors and/or associate tutors.
Cancellation Policy for Lesson Bookings

Please read and understand the following cancellation policy that applies to all lesson bookings with members of the HKSpanishtutoring team and our associate tutors:

1a. Cancellation of lessons by Client
​
1a.1 If the Client needs to cancel a scheduled lesson, they must provide notice through our designated communication channels available on the Website.
1a.2 Cancellations made more than 24 hours before the scheduled lesson will not incur any cancellation fees, unless it is a repeated cancellation, as stated in 1a.5.
1a.3 Cancellations made within 24 hours but before 4 hours of the scheduled lesson will incur a cancellation fee equivalent to 50% of the lesson fee, unless it is a repeated cancellation, as stated in 1a.5.
1a.4 Cancellations made within 4 hours of the scheduled lesson will incur a cancellation fee equivalent to 100% of the lesson fee.
1a.5 Repeated cancellations, defined as more than two cancellations of scheduled lessons within a one-month period, will incur a 100% full lesson cancellation fee.
1a.6 Clients who repeatedly cancel lessons, as defined in section 1.5, may be at risk of having their regular weekly or biweekly lesson slot terminated.
1a.7 If a third cancellation occurs within the same month, the client’s regular lesson slot may be terminated at the discretion of the tutor and/or founder of HKSpanishtutoring.
1a.8 Clients whose slots have been terminated due to repeated cancellations may reapply for a regular time slot after a period of one month, subject to availability and at the discretion of the founder of HKSpanishtutoring.
1a.9 If a Client wishes to cancel their weekly or bi-weekly lesson slot with their Tutor, we require at least 4 weeks notice.

1b. Payment and Refund Policy
​
1b.1 No refunds will be provided for lessons cancelled less than 24 hours in advance or for any additional charges incurred due to repeated cancellations.
1b.2 In cases where a lesson slot is terminated due to repeated cancellations, any pre-paid future lessons that are not subject to the repeat cancellation fee, will be refunded, minus any applicable cancellation and administrative fees.
1b.3 All cancellations must be communicated via email or phone if within 48 hours of a scheduled lesson, or can be cancelled via the online booking system if more than 48 hours prior to the scheduled lessons.
1b.4 If a Client wishes to cancel their weekly or bi-weekly lesson slot with their Tutor, we require at least 4 weeks notice. Any lessons that have been pre-paid during the 4 week notice period will not be refunded.
1b.5 Any disputes or concerns regarding cancellations, charges, or terminations should be addressed in writing to the founder of HKSpanishtutoring within seven days of the incident.
1b.6 The founder of HKSpanishtutoring will review and respond to disputes within seven days of receipt. The decision made will be final and binding.

​2. Cancellation by Tutor
​
2.1 In the event that a Tutor needs to cancel a scheduled lesson, they will provide reasonable notice to the Client through the designated communication channels on the Website.
2.2 If a Tutor cancels a lesson, the Client will have the option to reschedule the lesson for another mutually agreed-upon time or receive a full refund of the lesson fee.

3. Exceptions
​
3.1 This cancellation policy applies to all lesson bookings.
3.2 In exceptional cases, the cancellation policy may be waived at the discretion of HKSpanishtutoring provided the Client and Tutor are able to find a mutually agreed time to reschedule the lesson within the same week. However please note that during peak hours it is very unlikely that our Tutors will have availability to reschedule lessons in the same week.
3.3 To be considered for the exception above, the Client must provide valid and documented reasons for the cancellation within a reasonable time frame.

4. Lesson Punctuality
​
4.1 The Client is responsible for being punctual for scheduled lessons. The lesson will be considered to have commenced at the agreed-upon start time, regardless of the Client's actual attendance.
4.2 If the Client arrives late for a lesson, the Tutor is not obliged to extend the lesson beyond the scheduled end time. The full lesson fee will still apply.

5. Refunds
​
5.1 Refunds for cancelled lessons will be processed using the same payment method used for the original booking.
5.2 Depending on the payment method and processing time of financial institutions, it may take a few business days for the refund to appear in the Client's account.

6. Lesson Rescheduling
​
6.1 Clients who wish to reschedule a lesson must provide notice through the designated communication channels available on the Website.
6.2 Rescheduling requests will be accommodated based on the Tutor's availability and schedule and are subject to cancellation fees if made within the timeframes outlined in the cancellation policy.

7. Modification of Cancellation Policy

7.1 HKSpanishtutoring reserves the right to modify or update this cancellation policy at any time without prior notice.
7.2 The most recent version of the cancellation policy will be posted on this Website.

By booking and attending lessons with HKSpanishtutoring and our associate tutors, you acknowledge that you have read, understood, and agreed to this cancellation policy. Terms of Service

1. Grade Guarantee and Termination
​
1.1 We do not guarantee specific student grades as a result of our lessons. While we strive to provide high-quality tutoring services, academic outcomes depend on various factors, including the student's efforts, abilities, and external influences.
1.2 We reserve the right to terminate lessons with clients at any point if there are valid reasons, including but not limited to inappropriate behaviour, violation of our policies, or failure to adhere to the agreed-upon terms and conditions.

2. Lesson Prices and Dynamic Pricing
​
2.1 Lesson prices are subject to change at any point, at our sole discretion. Changes in lesson prices will be communicated to current clients with at least 1 month's notice before the new prices take effect.
2.2 Dynamic pricing may apply, and lesson prices may vary based on factors such as tutor availability, subject matter, and demand.

3. Payment and Billing
​
3.1 Lesson fees are payable in advance, and payment must be made through the designated payment method as detailed on invoice or agreed upon through other means.
3.2 Clients are responsible for providing accurate billing information and ensuring that payment details are kept up-to-date.
3.3 Failure to make upfront payment prior to scheduled lessons (minimum 4 lessons at a time) may result in termination of lessons and your dedicated weekly/bi-weekly lesson slot.
3.4 If you are booking lessons on an ad-hoc basis using the online booking system, which is an option during day-time hours and school holidays (subject to availability), an invoice will be sent via email either prior to, or just after the lesson has been delivered and payment must be made within 7 days of the invoice date.

4. Client Responsibilities
​
4.1 Clients are expected to actively participate in lessons, complete assignments, and engage constructively with the tutor to maximise the learning experience.
4.2 Clients are responsible for ensuring they have the necessary resources and materials to participate in the lessons.
4.3 It is the client's responsibility to inform the tutor of any specific learning objectives or preferences to tailor the lessons accordingly.

5. Tutoring Methodology
​
5.1 Our tutors employ their expertise and best practices to facilitate learning. However, the specific tutoring methodology may vary based on individual student needs and subject matter.
5.2 Tutors may provide learning resources, practice materials, and guidance, but the onus remains on the client to put forth effort and dedication towards their academic goals.

6. Confidentiality

6.1 Any personal information shared by clients during lessons or through our communication channels will be treated in accordance with our privacy policy.

7. Use of our Online Booking System
Our online tuition service is unique in that we have an online booking system. During non-peak hours (before 3.30pm) and UK school holidays, we allow clients the flexibility to book online Spanish lessons, at a time and on a day that suits. Due to high demand for online lessons at peak after-school/evening hours during UK school term times, we ask clients to commit to a specific time and day and only offer block-bookings of lessons with our tutors during these periods. After a first paid trial lesson with your tutor, we require upfront payment of 4 lessons at a time to secure your lesson slot.

8. Modification of Terms

8.1 We reserve the right to modify or update these terms and conditions at any time without prior notice.
8.2 The most recent version of the terms and conditions will be posted on the Website.

Client's Responsibility for Zoom/Google Meet and Internet Connection

1. Client Responsibility for Technology and Internet Connection
​
1.1 The Client acknowledges and agrees that it is their sole responsibility to ensure that they have access to the necessary technology, including but not limited to Zoom or Google Meet, to participate in online lessons with the Tutors.
1.2 The Client must have a compatible device (e.g., computer, tablet, smartphone) with a functioning camera, microphone, and internet connection suitable for video conferencing.
1.3 The Client must have a reliable and stable internet connection with adequate bandwidth to support uninterrupted participation in the online lessons.
1.4 The Client shall take all necessary steps to ensure their Zoom or Google Meet accounts are active and in good standing before the scheduled lesson.
1.5 The Client is responsible for updating the necessary software or applications required for accessing and using Zoom or Google Meet for the lessons.

2. Lesson Fees and Payment
​
2.1 By scheduling and participating in a lesson with a Tutor, the Client agrees to pay the applicable lesson fee.
2.2 The lesson fee shall be communicated to the Client at the time of booking or before the lesson.
2.3 The Client understands and agrees that they shall be liable to pay the lesson fee regardless of whether the lesson is completed or not, except in cases where the Tutor fails to fulfil their obligations as outlined in these Terms.
2.4 The Client acknowledges and agrees that any issues with their internet connection or technology, which result in the inability to participate fully in the lesson, do not exempt them from the responsibility to pay the lesson fee.

3. Tutor's Responsibility
​
3.1 The Tutor shall use their best efforts to provide a high-quality lesson experience to the Client.
3.2 In the event of any connection or technology error on behalf of the Tutor that significantly disrupts the lesson and makes it impossible for the Client to continue, the Client may request a rescheduling of the lesson or a refund of the lesson fee.
3.3 The Tutor shall not be held responsible for any technical issues or internet connectivity problems experienced by the Client during the lesson, as long as the Tutor's connection and technology are functioning correctly.

4. Cancellation and Rescheduling
​
4.1 The Client may cancel or reschedule a lesson by providing reasonable notice to the Tutor via either email, phone or the online booking system.
4.2 Cancellation or rescheduling requests made by the Client within a reasonable time frame before the scheduled lesson may be accommodated at the Tutor's discretion.

5. Modification of Terms
​
5.1 These Terms may be updated or modified from time to time at the sole discretion of the founder of HKSpanishtutoring. The updated Terms will be posted on this Website.
5.2 It is the Client's responsibility to review the Terms regularly. Continued use of the online booking system and services provided by our tutors after any modifications to the Terms constitutes the Client's acceptance of the revised Terms.

By booking lessons via email, phone or the online booking system and engaging in lessons with our Tutors and or/associate Tutors, you acknowledge that you have read, understood, and agree to be bound by these Terms and any additional guidelines or rules posted on this website. If you do not agree with any part of these Terms, you must not use the online booking system or book lessons with our Tutors.

Assignment Responsibility

1 Homework Assignments
​
1.1. Assignment Responsibility: If deemed necessary and appropriate by the tutor, students/tutees are expected to complete assigned homework tasks between lessons. These tasks are carefully chosen to reinforce learning, practise skills, and prepare students/tutees for their specific Spanish course or exam.
1.2. Submission Deadline: Homework tasks must be submitted by the agreed-upon deadline, as communicated by the tutor. Late submissions may affect the effectiveness of the tuition.
1.3. Importance of Homework: Completing homework is essential for maximising the benefits of tuition. It reinforces concepts learned during lessons, aids in retention, and prepares students for upcoming challenges in their Spanish studies.

2. Progress Evaluation
​
2.1. Assessment Criteria: Student progress will be evaluated based on their performance in lessons, completion of homework tasks, and/or any additional assessments deemed necessary by the tutor.
2.2. Feedback: When the tutor feels it is appropriate and necessary to do so, feedback via email or phone will be provided to students and/or their legal guardians to track progress and address any areas that may require additional attention. Parents are welcome to request feedback via email, providing an opportunity to discuss their child's performance, address any concerns, and celebrate achievements.

3. Course or Exam Preparation
​
3.1. Alignment with Objectives: Lessons and homework tasks will be aligned with the specific objectives of the student, whether it be preparation for a particular Spanish course or an upcoming exam.
3.2. Customised Approach: The tutor will tailor lessons and assignments to meet the individual needs and goals of each student.

4. Miscellaneous

4.1. Communication: Effective communication between the student, legal guardians, and the tutor is crucial for the success of the tuition. Any concerns, queries, or requests for adjustments should be promptly communicated.
4.2. Amendments to Terms: We reserve the right to modify or update these terms and conditions at any time without prior notice.

Associate Tutors - Service and Liability Disclaimer
By engaging with our services, you agree to comply with and be bound by the following terms and conditions. These terms govern your use of our services and clarify the responsibilities of all parties involved.

1. Independent Contractors

All individuals engaged by HKSpanishtutoring as team members, tutors, instructors, or any other form of educational service providers (hereinafter referred to as "Associate Tutors") are independent contractors and not employees of HKSpanishtutoring. As independent contractors, Associate Tutors operate autonomously and are solely responsible for the content and conduct of their work.

2. Limitation of Liability
​
The Founder of HKSpanishtutoring (hereinafter referred to as "Founder") shall not be held liable for any work carried out by Associate Tutors. This includes, but is not limited to, any teaching methods, educational materials, advice, guidance, or any other services provided by the Associate Tutors. The Founder does not oversee the day-to-day operations or the specific actions of the Associate Tutors.

3. Responsibilities of Associate Tutors
​
Associate Tutors are responsible for ensuring that their services meet the standards and requirements of the clients they serve. They must adhere to all applicable laws, regulations, and ethical guidelines in their respective fields. Any agreements or disputes arising from the services provided by an Associate Tutor are between the Associate Tutor and the client directly.

4. Client Acknowledgment

By using our services, clients acknowledge and agree that HKSpanishtutoring and the Founder are not responsible for the quality, accuracy, or outcomes of the services provided by Associate Tutors. Clients are encouraged to directly communicate with Associate Tutors to address any concerns or questions regarding their services.

5. Indemnification

Clients and Associate Tutors agree to indemnify, defend, and hold harmless the Founder and HKSpanishtutoring from and against any and all claims, liabilities, losses, damages, costs, or expenses (including legal fees) arising out of or in connection with the services provided by Associate Tutors.

6. Amendments
​
HKSpanishtutoring reserves the right to modify these terms and conditions at any time. Any changes will be effective immediately upon posting on our website. It is the responsibility of clients and Associate Tutors to review these terms regularly to ensure they are aware of any updates.

7. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of the UK. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of the UK.
