Terms & Conditions

The following Terms and Conditions govern your use of the online booking system and the services provided by all tutors and associate tutors of HKSpanishtutoring. By using the online booking system and engaging in lessons, you agree to be bound by these Terms. Please read and understand these Terms before booking lessons.

Cancellation Policy for Lesson Bookings

​

1a. Cancellation by Client

1. Clients must cancel lessons through designated communication channels on the Website.

2. Cancellations made more than 24 hours before a scheduled lesson incur no fee unless it is a repeated cancellation (see 1a.4).

3. Cancellations within 24 hours of the lesson incur a 100% fee.

4. Repeated cancellations (more than twice in a month) will incur a 100% cancellation fee.

5. Clients repeatedly cancelling lessons risk losing their regular slot.

6. If three cancellations occur in a month, the lesson slot may be terminated.

7. Clients whose slots are terminated due to repeated cancellations may reapply after one month, subject to availability.

8. To cancel a weekly or biweekly lesson slot, at least 4 weeks' notice is required.

1b. Payment & Refund Policy

1. No refunds for cancellations made less than 24 hours in advance.

2. If a slot is terminated due to repeated cancellations, pre-paid lessons may be refunded minus applicable fees.

3. Cancellations must be communicated via email or phone if within 48 hours of a lesson or via the online booking system if more than 48 hours prior.

4. Pre-paid lessons during the 4-week notice period are non-refundable.

5. Any disputes must be submitted in writing within seven days.

6. The founder will review disputes within seven days, and the decision is final.

2. Cancellation by Tutor

1. Tutors will provide reasonable notice if they need to cancel a lesson.

2. Clients can reschedule or receive a full refund if the tutor cancels a lesson.

3. Exceptions

1. The cancellation policy applies to all bookings.

2. In exceptional cases, the policy may be waived if rescheduling within the same week is possible.

3. Clients must provide valid documentation for exceptions to be considered.

4. Lesson Punctuality

1. Clients must be punctual; lessons start at the agreed time regardless of actual attendance.

2. Tutors are not obligated to extend lessons for late arrivals.

5. Refunds

1. Refunds will be processed via the original payment method.

2. Processing time depends on the payment provider.

6. Lesson Rescheduling

1. Clients must request rescheduling via designated channels.

2. Rescheduling is subject to tutor availability and cancellation fees.

7. Modification of Cancellation Policy

1. HKSpanishtutoring may update this policy at any time.

2. The latest version will be posted on the Website.

Terms of Service

​

1. Grade Guarantee & Termination

1. HKSpanishtutoring does not guarantee specific grades.

2. Lessons may be terminated for inappropriate behavior, policy violations, or non-adherence to terms.

2. Lesson Prices & Dynamic Pricing

1. Prices are subject to change with at least one month’s notice.

2. Dynamic pricing may apply based on tutor availability and demand.

3. Payment & Billing

1. Lesson fees are payable in advance.

2. Clients must provide accurate billing details.

3. Failure to pay upfront (minimum 4 lessons) may result in termination of lessons.

4. Ad-hoc bookings require payment within 7 days of the invoice date.

4. Client Responsibilities

1. Clients must actively participate, complete assignments, and engage with tutors.

2. Clients must ensure they have the required learning materials.

3. Clients should communicate learning objectives to tutors.

5. Tutoring Methodology

1. Tutors use expert methods tailored to student needs.

2. Tutors provide resources, but students must put in effort.

6. Confidentiality

1. Personal information is handled per our privacy policy.

7. Online Booking System

1. Clients may book adhoc lessons online during non-peak hours.

2. Peak hours require a fixed weekly slot with upfront payment of four lessons.

8. Modification of Terms

1. HKSpanishtutoring may update these terms at any time.

2. The latest terms will be posted on the Website.

Client Responsibility for Technology

​

1. Clients must have a suitable device and stable internet connection.

2. Clients must ensure Zoom/Google Meet is functional before lessons.

3. No refunds for lessons affected by client-side technical issues.

4. If a tutor’s technical issue disrupts the lesson, a reschedule or refund may be offered.

Assignment Responsibility

1. Homework Assignments

1. Students may be assigned homework to reinforce learning.

2. Assignments must be submitted on time.

3. Homework is essential for effective learning.

2. Progress Evaluation

1. Tutors evaluate students based on lesson participation, homework, and assessments.

2. Feedback may be provided at the tutor’s discretion.

3. Exam & Course Preparation

1. Lessons align with the student’s academic goals.

2. Tutors tailor lessons to individual needs.

Associate Tutors - Service & Liability Disclaimer

1. Independent Contractors

1. Associate Tutors are independent contractors, not employees.

2. They operate autonomously and are responsible for their work.

2. Limitation of Liability

1. The Founder is not liable for Associate Tutors' teaching methods, materials, or advice.

3. Responsibilities of Associate Tutors

1. Associate Tutors must adhere to legal and ethical guidelines.

2. Any disputes are between the Associate Tutor and the client.

4. Client Acknowledgment

1. Clients acknowledge that HKSpanishtutoring is not responsible for Associate Tutors’ services.

5. Indemnification

1. Clients and Associate Tutors indemnify HKSpanishtutoring against claims or disputes.

6. Amendments

1. HKSpanishtutoring may modify these terms at any time.

2. Updates take effect immediately upon posting.

7. Governing Law

1. These terms are governed by UK law.

2. Disputes are subject to UK courts.

Privacy Policy

1. Tutors collect names, contact details, educational background, and invoicing details.

2. Communication records may be stored for quality assurance.

2. Use of Personal Information

1. Personal information is used for tutoring, communication, and invoicing.

1. Personal information is safeguarded but absolute security cannot be guaranteed.

2. Information will not be shared without consent unless required by law.

4. Retention of Personal Information

1. Data is retained as long as necessary for tutoring and legal compliance.
